Privacy policy - Moovin Interiors
- This Privacy Policy sets out the rules for the processing of personal data obtained via the website moovininteriors.pl (hereinafter referred to as the "Website").
- The owner of the Website and the data controller is Dawid Forysiak, conducting business activity under the name Dawid Forysiak, with its registered office in Warsaw (01-208), Przyokopowa 33, entered into the Central Register and Information on Business Activity maintained by the Minister of Development, Labor and Technology, NIP: 9291674907, REGON: 147484113, hereinafter referred to as Moovininteriors.pl.
- Personal data collected by Moovininteriors.pl via the Website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), also known as GDPR.
- Moovininteriors.pl takes special care to respect the privacy of Users visiting the Website. § 2 Type of data processed, purposes and legal basis
- Moovininteriors.pl collects information on natural persons performing legal acts not directly related to their business activity, natural persons conducting business or professional activity on their own behalf, and natural persons representing legal persons or organizational units that are not legal persons but which are granted legal capacity by law, hereinafter collectively referred to as Users.
- Users' personal data are collected when: a) using the contact form service on the Website for the performance of a contract provided electronically. Legal basis: necessary for the performance of a contract for the provision of the contact form service (Article 6, paragraph 1, letter b of the GDPR); b) using the telephone call booking service on the Website for the performance of a contract provided electronically. Legal basis: necessary for the performance of a contract for the provision of the telephone call booking service (Article 6, paragraph 1, letter b of the GDPR).
- When using the contact form service, the User provides the following data:
a) email address;
b) name and surname;
c) telephone number. - In case of using the telephone call booking service, the User provides:
a) email address;
b) telephone number. - When using the Website, additional information may be downloaded, in particular: the IP address assigned to the User's computer or the external IP address of the Internet provider, domain name, browser type, access time, type of operating system.
- Navigational data may also be collected from Users, including information about the links and hyperlinks they choose to click or other actions they take on the Website. Legal basis – legitimate interest (Article 6, paragraph 1, letter f of the GDPR), consisting in facilitating the use of services provided electronically and improving the functionality of those services.
- For the purpose of establishing, pursuing, and enforcing claims, certain personal data provided by the User when using the functionalities on the Website may be processed, such as: first name, last name, data regarding the use of services if the claims arise from the manner in which the User uses the services, and other data necessary to prove the existence of the claim, including the extent of the damage suffered. Legal basis – legitimate interest (Article 6, paragraph 1, letter f of the GDPR), consisting in the establishment, pursuit, and enforcement of claims, as well as defense against claims in proceedings before courts and other state authorities.
- Providing personal data to Moovininteriors.pl is voluntary. § 3 Who is the data shared or entrusted to and how long is it stored?
- Users' personal data are transferred to service providers used by Moovininteriors.pl to operate the Website. Service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, are either subject to Moovininteriors.pl's instructions regarding the purposes and methods of processing this data (processors) or independently determine the purposes and methods of processing (controllers). a) Processors. Moovininteriors.pl uses providers who process personal data solely on Moovininteriors.pl's instructions. These include, among others, providers of hosting services, accounting services, marketing systems, systems for analyzing website traffic, and systems for analyzing the effectiveness of marketing campaigns; b) Controllers. Moovininteriors.pl uses providers who do not act solely on instructions and independently determine the purposes and methods of using Users' personal data. They provide electronic payment and banking services.
- Location. Service providers are based in Poland and other countries of the European Economic Area (EEA).
- Users' personal data are stored: a) If consent is the basis for personal data processing, the User's personal data is processed by Moovininteriors.pl until consent is revoked, and after revocation of consent, for a period corresponding to the limitation period for claims that Moovininteriors.pl may raise and that may be brought against it. Unless a specific provision provides otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to running a business – three years. b) If the basis for data processing is the performance of a contract, the User's personal data is processed by Moovininteriors.pl for as long as necessary to perform the contract, and after that time, for a period corresponding to the limitation period for claims. Unless a specific provision provides otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to running a business – three years.
- Navigation data may be used to provide Users with better service, to analyze statistical data and to adapt the Website to Users' preferences, as well as to administer the Website.
- In the event of a request, Moovininteriors.pl shares personal data with authorized state authorities, in particular organizational units of the Prosecutor's Office, the Police, the President of the Office for Personal Data Protection, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications. § 4 Cookie mechanism, IP address
- The Website uses small files called cookies. Moovininteriors.pl stores them on the end device of the Website visitor, if the web browser allows it. A cookie typically contains the name of the domain from which it originates, its expiration date, and a randomly selected number identifying the file. Information collected using these types of files helps Moovininteriors.pl tailor the products offered by Moovininteriors.pl to the individual preferences and actual needs of Website visitors. They also enable the development of general statistics on visits to the products presented on the Website.
- Moovininteriors.pl uses two types of cookies: a) Session cookies: after the browser session ends or the computer is turned off, the stored information is deleted from the device's memory. The session cookie mechanism does not allow the collection of any personal data or any confidential information from Users' computers. b) Persistent cookies: these are stored in the memory of the User's end device and remain there until they are deleted or expired. The persistent cookie mechanism does not allow the collection of any personal data or any confidential information from Users' computers.
- Moovininteriors.pl uses its own cookies for the following purposes: a) analysis, research and audience auditing, and in particular to create anonymous statistics that help understand how Users use the Website, which enables the improvement of its structure and content.
- Moovininteriors.pl uses external cookies for the purpose of: a) popularizing the Website using the Facebook.com social networking site (external cookie administrator: Facebook Inc. based in the USA or Facebook Ireland based in Ireland); b) presenting a map on the Website indicating the location of the Moovininteriors.pl office, using the maps.google.com website (external cookie administrator: Google Inc. based in the USA);
c) collecting general and anonymous statistical data via Google Analytics analytical tools (external cookie administrator: Google Inc. based in the USA);
d) presentation of the Reliable Regulations Certificate via the website rzetelnyregulamin.pl (external cookie administrator: Rzetelna Grupa sp. z o. o. with its registered office in Warsaw).
- The cookie mechanism is safe for Website Users' computers. In particular, it is impossible for viruses or other unwanted software or malware to enter Users' computers this way. However, Users have the option of limiting or disabling cookie access to their computers in their browsers. If this option is used, the Website will still be usable, except for functions that, by their nature, require cookies.

f) Opera browser. - Moovininteriors.pl may collect User IP addresses. An IP address is a number assigned to the computer of a Website visitor by their Internet service provider. An IP number allows access to the Internet. In most cases, it is assigned to a computer dynamically, meaning it changes with each Internet connection. Moovininteriors.pl uses IP addresses to diagnose technical server problems, create statistical analyses (e.g., determine which regions receive the most visits), as information useful in administering and improving the Website, as well as for security purposes and to identify server-intensive, unwanted automated programs browsing the Website content.
- The Website contains links and references to other websites. Moovininteriors.pl is not responsible for the privacy policies of those websites. Therefore, we encourage you to review the privacy policy of another administrator after accessing the Website. § 5 Data Subject Rights
- The right to withdraw consent – legal basis: Article 7, paragraph 3 of the GDPR. a) The User has the right to withdraw any consent he has given
Moovininteriors.pl.b) Withdrawal of consent takes effect from the moment of withdrawal of consent.
c) Withdrawal of consent does not affect the processing carried out by Moovininteriors.pl in accordance with the law before its withdrawal.
d) Withdrawal of consent does not entail any negative consequences for the User, but may prevent further use of services or functionalities which, according to the law, Moovininteriors.pl may only provide with consent.
- Right to object to data processing – legal basis: Article 21 of the GDPR.a) The User has the right to object at any time – for reasons related to their particular situation – to the processing of their personal data, including profiling, if Moovininteriors.pl processes their data based on a legitimate interest, e.g. marketing of Moovininteriors.pl products and services, maintaining statistics on the use of individual functionalities of the Website and facilitating the use of the Website, as well as satisfaction surveys.b) Unsubscribing by e-mail from receiving marketing communications regarding products or services will mean the User's objection to the processing of their personal data, including profiling for these purposes.
c) If the User's objection proves to be justified and Moovininteriors.pl has no other legal basis for processing personal data, the User's personal data will be deleted, to the processing of which the User has objected.
- Right to erasure (“right to be forgotten”) – legal basis: Article 17 of the GDPR.a) The User has the right to request the erasure of all or some of the personal data.b) The User has the right to request the erasure of the personal data if: a. the personal data are no longer necessary for the purposes for which they were collected

This applies in particular to personal data including: first name, last name, email address, which are retained for the purpose of handling complaints and claims related to the use of Moovininteriors.pl services, and additionally, residential/mailing address, order number, which are retained for the purpose of handling complaints and claims related to concluded sales contracts or the provision of services.
- The right to restrict data processing – legal basis: Article 18 of the GDPR. a) The User has the right to request the restriction of the processing of their personal data. Submitting a request, until it is considered, prevents the use of certain functionalities or services, the use of which will involve the processing of the data covered by the request. Moovininteriors.pl will also not send any communications, including marketing communications. b) The User has the right to request the restriction of the use of personal data in the following cases:
a. when he/she questions the accuracy of his/her personal data – then Moovininteriors.pl limits their use for the time needed to verify the accuracy of the data, but no longer than for 7 days;
b. when the data processing is unlawful and instead of deleting the data, the User requests the restriction of their use;
c. when personal data are no longer necessary for the purposes for which they were collected or used but are still needed by the User to establish, pursue or defend claims;
d. when he has objected to the use of his data – then the restriction takes place for the time needed to consider whether – due to the specific situation – the protection of the User’s interests, rights and freedoms outweighs the interests pursued by the Controller in processing the User’s personal data. - Right of access to data – legal basis: Article 15 of the GDPR.a) The User has the right to obtain confirmation from the Controller whether he processes personal data, and if so, the User has the right to:
a. access your personal data;
b. obtain information about the purposes of processing, the categories of personal data processed, the recipients or categories of recipients of such data, the planned period of storage of the User's data or the criteria for determining this period (when it is not possible to determine the planned period of data processing), the User's rights under the GDPR and the right to lodge a complaint with a supervisory authority, the source of such data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of such data outside the European Union;
c. obtain a copy of your personal data. - Right to rectification – legal basis: Article 16 of the GDPR.a) The User has the right to request the Controller to immediately rectify any inaccurate personal data concerning them. Taking into account the purposes of processing, the User whose data is processed has the right to request that incomplete personal data be supplemented, including by providing an additional statement, by sending a request to the email address specified in §6 of the Privacy Policy.
- Right to data portability – legal basis: Art. 20 GDPR.a) The User has the right to receive their personal data provided to the Controller and then transmit it to another personal data controller of their choice. The User also has the right to request that the Controller transmit their personal data directly to such controller, if technically feasible. In such a case, the Controller will transmit the User's personal data in the form of a CSV file, which is a commonly used, machine-readable format that allows the data received to be transmitted to another personal data controller.
- If the User exercises the above rights, Moovininteriors.pl will either comply with the request or refuse to comply with it immediately, but no later than one month after receiving it. However, if – due to the complex nature of the request or the number of requests – Moovininteriors.pl is unable to comply with the request within one month, it will comply within the next two months, informing the User within one month of receiving the request of the intended extension and the reasons therefor.
- The User may submit complaints, inquiries and requests to the Administrator regarding the processing of his or her personal data and the exercise of his or her rights.
- The User has the right to request from Moovininteriors.pl a copy of standard contractual clauses by sending an inquiry in the manner indicated in §6 of the Privacy Policy.
- The User has the right to lodge a complaint with the President of the Personal Data Protection Office regarding the violation of his/her rights to personal data protection or other rights granted under the GDPR. § 6 Changes to the Privacy Policy
